Distance Sales Agreement

By accepting this contract, the BUYER agrees in advance that if the order covered by this contract is approved , they will be under the obligation to pay the order amount and any additional fees such as shipping costs and taxes, and acknowledges being informed about this.

  1. DEFINITIONS

The terms written below shall have the following meanings in the application and interpretation of this Agreement:

LAW: The Law No. 6502 on Consumer Protection,

REGULATION: Regulation on Distance Contracts (OG: 27.11.2014/29188),

SERVICE: Any consumer transaction other than providing goods, done or committed to be done for a fee or benefit,

SELLER: The company that offers goods to th  e consumer within the scope of its commercial or professional activities, or acts on behalf of or accounts for those who offer goods,

BUYER: The real or legal person acquiring, using, or benefiting from a good or service for non-commercial or non-professional purposes,

SITE: The website belonging to the SELLER,

ORDERING PERSON: The real or legal person requesting a good or service through the website belonging to the SELLER,

PARTIES: The SELLER and the BUYER,

CONTRACT: This agreement concluded between the SELLER and the BUYER,

GOODS: The movable goods subject to shopping, as well as software, sound, image, and similar intangible goods prepared to be used in an electronic environment.

  1. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts regarding the sale and delivery of the product ordered electronically by the BUYER from the website belonging to the SELLER, with the characteristics and sales price indicated below.

The listed and announced prices on the site are sales prices. The announced prices and promises are valid until they are updated and changed. Prices announced for a certain period are valid until the end of the specified period.

If a campaign has been organized by the seller, you can examine the main characteristics of the relevant product during the campaign period. It is valid until the campaign date.
  3. The listed and announced prices on the site are sales prices. The announced prices and promises are valid until they are updated and changed. Prices announced for a certain period are valid until the end of the specified period.

  1. The shipping cost, which is the product shipment fee, will be paid by the BUYER.

Invoice Delivery: The invoice will be delivered with the order at the time of order delivery to the invoice address.

  1. GENERAL PROVISIONS
  2. The BUYER acknowledges, declares, and undertakes that they have read the preliminary information on the basic characteristics of the product subject to the contract, the sales price, payment method, and delivery on the website belonging to the SELLER, and have provided the necessary electronic confirmation. The BUYER acknowledges, declares, and undertakes that they have obtained the correct and complete information about the address to be provided by the SELLER, the basic characteristics of the ordered products, the price including taxes, payment, and delivery information before the establishment of the distance sales contract by confirming the Preliminary Information electronically.
  3. Each product subject to the contract shall be delivered to the BUYER or to the person or organization at the address indicated by the BUYER within the period specified in the preliminary information section on the website, depending on the distance of the BUYER’s place of residence, not exceeding the legal 30-day period. In case the product cannot be delivered to the BUYER within this period, the BUYER reserves the right to terminate the contract.
  4. The SELLER acknowledges, declares, and undertakes to deliver the product subject to the contract completely, in accordance with the specifications specified in the order, and with warranty certificates, user manuals, if any, information and documents required by the nature of the work, to perform the work accurately and honestly in accordance with the requirements of the legal legislation, to maintain and increase the quality of service, to show the necessary attention and care during the performance of the work, and to act with caution and foresight.
  5. The SELLER may supply a different product of equal quality and price by informing the BUYER and obtaining their explicit approval before the fulfillment period of the contractual obligation expires.
  6. If the SELLER fails to fulfill the contractual obligations in case the delivery of the ordered product or service becomes impossible, it shall notify the consumer in writing within 3 days from the date it learns of this situation, and return the total amount to the BUYER within 14 days.
